Terms of Use

Welcome to Actulyze. These Terms of Use apply when you access or use the Actulyze website, mobile app, content, subscriptions and related services, together called the Service.

The Service is provided by Actulyze Pty Ltd (ABN 79 690 780 799), an Australian company based in Melbourne, Victoria. By creating an account, purchasing a subscription, selecting 'I agree' or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Actulyze is intended for people aged 16 or older. By using the Service, you confirm that you are at least 16 and legally able to agree to these Terms. If the law where you live requires you to be older, that older age applies. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and consent to your use of Actulyze.

You must provide accurate account information and keep it current. You are responsible for protecting your login details and for activity on your account. Contact support@actulyze.com promptly if you believe your account has been accessed without permission.

Actulyze provides general wellbeing and self-reflection tools designed to help you practise supporting yourself through what you feel, what you do and how you show up. Features may include check-ins, guided practices, questionnaires, progress information, educational content and reminders.

Actulyze does not guarantee a particular result. Your experience will depend on your circumstances and how you use the Service.

Actulyze provides general wellbeing and self-reflection tools. It does not provide medical diagnosis or treatment, is not a substitute for care from a qualified health professional, and is not an emergency service.

Do not rely on Actulyze in an emergency or where urgent support is needed. If you or another person may be in immediate danger, contact your local emergency service. In Australia, call 000. In the United States, call 911 or call or text 988 for crisis support.

Use your own judgement when deciding whether a practice is suitable for you. Stop using a practice and seek appropriate professional advice if it causes concern or distress. Never disregard professional advice because of information provided through Actulyze.

Actulyze may offer free and paid features. Before you purchase a subscription, you will be shown the subscription name, what it includes, its duration, total price, billing frequency, applicable taxes, renewal terms and any free-trial conditions.

Subscriptions renew automatically for the period shown at purchase unless cancelled before the renewal deadline. If a trial converts to a paid subscription, the trial length and the amount charged after the trial will be shown before you begin.

Subscriptions purchased through Apple are charged to your Apple Account when purchase is confirmed and renew automatically for the same subscription period until cancelled. You can manage or cancel an Apple subscription in your Apple Account subscription settings. Current subscribers can restore eligible purchases through the app. Other purchase channels may provide their own cancellation process.

Cancellation stops the next renewal and normally takes effect at the end of the current paid period. Deleting the app or your Actulyze account does not automatically cancel an active subscription. Cancelling a subscription does not automatically delete your account.

Refund requests for Apple purchases are handled by Apple, except where applicable law requires otherwise. If we increase a recurring subscription price, the new price will apply only after any notice and consent required by law or the relevant app store. Nothing in this section limits any refund, cancellation or consumer right that cannot lawfully be excluded.

While you comply with these Terms, Actulyze gives you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for your own non-commercial purposes.

The Service is licensed, not sold. This licence does not give you ownership of the app, website, software, content, branding or other Actulyze materials.

You must not use the Service unlawfully or in a way that could harm another person, Actulyze or the Service. This includes attempting to gain unauthorised access; interfering with security or operation; introducing malicious code; scraping or automatically extracting content or data; copying, selling, sublicensing or commercially exploiting the Service; impersonating another person; infringing another person's rights; or reverse engineering the app except where applicable law expressly permits it.

We may take reasonable and proportionate steps to investigate misuse, protect users and maintain the security and integrity of the Service.

You retain ownership of information or content you enter into Actulyze.

You give Actulyze and its contracted service providers the limited permission needed to host, store, process and transmit that information to operate, support and secure the Service. We may use de-identified or aggregated information to understand and improve the Service where it can no longer reasonably identify you.

Only provide information about another person if you have their permission or another lawful right to do so. Our handling of personal information is explained in the Privacy Policy.

Actulyze and its licensors own the Service and the intellectual property in its software, design, branding, illustrations, text, practices and other supplied content. Except for the limited right to use the Service under these Terms, no intellectual property rights are transferred to you.

If you give us feedback or suggestions, we may use them without restriction or payment, but we will not identify you publicly without permission.

Our Privacy Policy explains what personal information we collect, why we collect it, how it is protected and the choices available to you.

Because some information entered into Actulyze may concern your emotional or mental wellbeing, we treat it as sensitive information where applicable law requires. Consent requested in the app for sensitive information is separate from your acceptance of these Terms.

The Service may interact with third-party services such as app stores, subscription platforms, authentication providers or links to external resources. Those services may have their own terms and privacy policies.

Actulyze is not responsible for a third-party service it does not control, but this does not remove any responsibility Actulyze has under applicable law.

If you download Actulyze through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to your licence to use the iOS app. These Terms govern your Actulyze account and the services we provide. If there is a conflict concerning the licence to the iOS app, Apple's Standard EULA controls.

We work to keep Actulyze available and secure, but the Service may occasionally be interrupted for maintenance, updates, security work or events outside our reasonable control.

We may add, change or discontinue features as the Service develops. We will give reasonable notice if a change materially reduces a paid feature during your current subscription period, unless an immediate change is needed for security, safety or legal reasons. Rights and remedies required by law continue to apply.

You may stop using Actulyze at any time. You can initiate account deletion through the app or contact support@actulyze.com for help.

We may restrict or suspend access if we reasonably believe there has been a serious breach of these Terms, a security threat, unlawful activity, a risk of harm or a legal requirement. Where appropriate, we will explain the reason and provide an opportunity to respond.

When an account ends, your licence to use the Service ends. Personal information is handled in accordance with the deletion and retention provisions in our Privacy Policy.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Except for those non-excludable rights, the Service is provided on an 'as available' basis. We do not promise that it will always be uninterrupted, error-free or suitable for every person or situation.

To the maximum extent permitted by law, Actulyze is not responsible for loss that was not reasonably foreseeable, resulted from use of the Service contrary to these Terms, was caused by a third-party service outside our control, or arose from events beyond our reasonable control.

Nothing in these Terms limits liability for fraud, wilful misconduct, personal injury caused by negligence or any other liability that cannot lawfully be limited or excluded.

We may update these Terms to reflect changes to the Service, our business or the law. We will publish the updated Terms and revise the date above.

If a change materially affects your rights or obligations, we will give reasonable advance notice unless an immediate change is needed for legal, security or safety reasons. If you do not agree to a material change, you may stop using the Service and cancel future subscription renewal before the change takes effect.

These Terms are governed by the laws of Victoria, Australia. This choice does not remove any mandatory consumer protection or other legal right that applies where you live. The courts with jurisdiction under applicable law may hear a dispute. If part of these Terms is found unenforceable, the remaining parts continue to apply.
